Sperring –v- Lyons

 

MOTORCYCLIST AWARDED £10,764.00 DAMAGES FOR PERSONAL INJURY AND FINANCIAL LOSSES AS A RESULT OF A ROAD TRAFFIC ACCIDENT.

 

We recently settled a personal injury claim for a client in the amount of £10,764.00 following a road traffic accident in September 2008.

This is the perfect example of a personal injury case that we as a firm will pursue despite the many hurdles along the way. In this particular situation the client was travelling on his motorbike when he approached a roundabout in the correct lane for his intended route when the Defendant changed lanes on the roundabout colliding with our client’s motorbike, causing him to fall to the ground and sustain a serious injury.

From the date the claim was presented to the Defendant insurers in October 2008 until a few weeks ago when we threatened to issue court proceedings, liability was firmly in dispute.

Despite there being a police report which suggested that our client was in the wrong lane, we persevered and eventually located a witness to the accident who held the Defendant fully at fault for the accident. Following this the Defendant insurers agreed to deal with our clients claim on a without prejudice basis. They initially offered £5,500.00 but we negotiated an increase for our client to £10,764.00 in the end.

The moral of the story is that if you have a genuine personal injury claim we will exhaust every avenue to enable you to receive the maximum compensation which you are entitled to at law.
