This case is an example of perseverance and persistence. The claimant a minor at the time was 9 years old (2001) and she was travelling as a back seat passenger when a car driven by the defendant, sped past, overtook, lost control and collided with her parked vehicle. The file was taken over from another firm in Central London on instructions from the Litigation Friend. Where a claimant is under aged the claims are persuaded on their behalf by a parent or guardian known in the legal terms as a “Litigation Friend”.
We corresponded over several years with the defendant’s insurers having obtained reports from an Orthopaedic Consultant and a Psychiatrist. The orthopaedic evidence showed that the minor claimant had suffered a fracture of humorous, however she made a complete recovery but showed symptoms of psychological damage. This was followed by a report from a Psychologist, who opined that the minor claimant had suffered from adjustment disorder with anxiety and that the psychological disturbance was caused as a result of the road traffic accident.
As the claimant was a minor we obtained an interim payment to fund her cost of treatment and eventually settled the claim in the sum of £10,977.00. The minor claimant initially lived in the Clerkenwell area of Central London, but at the time of settlement in 2013, now lives in Edmonton.
